Además, Schaeffler ha desarrollado varias apps, como por ejemplo la app OriginCheck, que desde un smartphone permiten detectar con facilidad el origen de un rodamiento, escaneando el código Data Matrix que se indica en el embalaje. Acciones contra la piratería de productos La falsificación de rodamientos y la distribución de estos productos son perseguidas de forma permanente por Schaeffler en todo el mundo, con tolerancia cero hacia aquellas empresas que hacen de la piratería una de las bases de su modelo de negocio. No tan sólo existe la amenaza de reclamaciones civiles solicitando el cese de la actividad, daños y la solicitud de entrega de los rodamientos para que sean destruidos, sino que también existe la amenaza de enjuiciamiento criminal, que puede conllevar multas o encarcelamiento. A su vez, Schaeffler ofrece el máximo soporte, colaboración y protección a las empresas que han sido víctimas del fraude, aquellas que pensando que estaban adquiriendo un producto original han adquirido un producto falsificado sin ningún tipo de garantía. Participación activa con asociaciones Asociaciones como la Asociación Mundial de Rodamientos, la Asociación Antifalsificaciones Alemana y el Comité de Protección de Marcas, con las que Schaeffler colabora, realizan una importante labor de concienciación y educativa, para que el público esté informado sobre los riesgos causados por el uso de productos industriales falsificados. Además de colaborar con fabricantes de componentes, estas organizaciones también trabajan conjuntamente con las autoridades pertinentes, con el objetivo de crear los prerrequisitos legales y organizacionales para luchar de forma efectiva contra las falsificaciones y por tanto proteger a fabricantes y clientes. En general, es siempre mejor comprar productos de una fuente 100% fiable, p.ej. directamente del fabricante o de distribuidores autorizados. Los esfuerzos dan resultado En los últimos años, gracias a los esfuerzos realizados se han logrado importantes incautaciones. Por ejemplo, la estrecha colaboración entre la Oficina Europea de Lucha contra el Fraude y la Unidad de Vigilancia Aduanera de Bizkaia hizo posible la intervención en el puerto de Le Havre (Francia) de varios contenedores con rodamientos falsificados de la marca FAG provenientes de China. Tras una intensa investigación las autoridades pertinentes llevaron a cabo una inspección en los almacenes de una empresa importadora donde se encontraron rodamientos de la marca “FAG” que, tras el correspondiente análisis pericial, resultaron ser falsos. Este es el caso más importante después de que en 2015, tras varios años de lucha, la Audiencia Provincial de Madrid condenó a una empresa importadora al pago de una indemnización por daños y perjuicios por valor de 7,6 M€ a Schaeffler Iberia por infringir su derecho de marca, una vez quedó demostrado que la empresa distribuía rodamientos falsificados de la marca FAG. Otros ejemplos de incautación de rodamientos falsificados dejan claro que estamos ante un problema global y puede afectar a todo el mundo. In addition to collaborating with component manufacturers, these organisations also work in conjunction with the relevant authorities, with the aimof creating the legal and organisational prerequisites to effectively combat counterfeits and thereby protect bothmanufacturers and clients. In general, it is always better to purchase products from a 100% reliable source, i.e. directly from the manufacturer or from authorised distributors. Efforts pay off Thanks to the efforts made, significant seizures have taken place in recent years. For example, the close collaboration between the European Anti-Fraud Office and the Bizkaia Customs Surveillance Unit enabled several containers of FAG brand counterfeit bearings originating from China to be intercepted in the Port of Le Havre (France). Following a thorough investigation, the relevant authorities inspected the warehouses of an importer where the “FAG” bearings were found and which the corresponding forensic analysis showed to be fake. This is the most important case since 2015 when, after several years of fighting, the Provincial Court of Madrid ruled that an importer must indemnify Schaeffler Iberia for damage amounting to €7.6m for having breached its brand rights, having proven that the company has been distributing counterfeit FAG bearings. Other examples of the seizure of counterfeit bearings clearly show that we are facing a global problem that can affect everyone.
