Gestión y Tratamiento de Residuos | Waste Management & Treatment www.futurenviro.es | Octubre-Noviembre October-November 2021 21 Este sistema telemático de notificación de traslado de residuos ha logrado el dudoso honor, en apenas un mes de uso, de unir a las principales asociaciones de la industria del reciclaje en contra de su uso por su falta de capacidad de tramitación, sus innumerables errores y su compleja operatividad. Desde el pasado día 1 de septiembre, los operadores deben hacer uso obligatorio del eSIR o del sistema telemático de aquellas comunidades autónomas que dispongan del suyo propio para los traslados de residuos sujetos al procedimiento de notificación previa. En apenas un mes de uso, como desgraciadamente aventuramos ya hace tiempo desde FER, el sector recuperador teme una paralización de la actividad sin precedentes por el mal funcionamiento de la tramitación electrónica obligatoria. Así se lo hemos hecho saber, nada menos que a través de un escrito firmado por 20 organizaciones que representamos a distintas actividades de producción y gestión de residuos, al Ministerio para la Transición Ecológica, solicitando al Secretario de Estado de Medio Ambiente, Hugo Morán, la suspensión temporal de la plataforma telemática eSIR hasta que se pueda garantizar su funcionamiento. En FER recibimos multitud de comunicaciones diarias de nuestras empresas socias denunciando que dicha plataforma no está suficientemente operativa por su falta de capacidad de tramitación, sus continuos errores y su dificultad de uso. Todo ello hace imposible que se puedan realizar los trámites digitales que establece la legislación, lo que genera inseguridad jurídica e incumple los objetivos de la norma. Es tal la preocupación de los productores y gestores sobre la situación actual, que sospechamos que el uso del eSIR puede llevar a la paralización de las recogidas de residuos, una cuestión muy grave que tendría consecuencias sanitarias, medioambientales y en el empleo. En la misiva enviada al Secretario de Estado de Medio Ambiente, también hemos reclamado la necesidad de establecer un trámite alternativo que otorgue seguridad jurídica cuando la tramitación electrónica no sea posible de realizar por causas ajenas a los administrados. Pese a que el objetivo de este procedimiento electrónico es poder trazar los residuos desde sus puntos de generación a los de tratamiento para asegurar el tratamiento más adecuado a sus características, algo que las organizaciones afectadas apoyan y promueven desde hace años por ser la digitalización de este proceso la piedra angular para lograr una economía más circular, no es menos cierto que, a día de hoy, no es posible realizar este procedimiento de forma electrónica. No lo es, en primer lugar, porque los tiempos de tramitación son excesivos. Frente a las estimaciones que se hicieron cuando se anunció este nuevo sistema, que suponía emplear menos de cinco minutos por cada documento que se tramitara, actualmente se está llegando a emplear incluso una hora por documento. The sector has made this known in a letter to the Ministry for Ecological Transition signed by no less than 20 organisations representing different waste production and management activities. The letter calls on the Secretary of State for the Environment, Hugo Morán, to suspend the eSIR telematic platform temporarily until its operation can be guaranteed. At FER we receive a multitude of daily complaints from our member companies, pointing out that the platform is not sufficiently operational due to lack of processing capacity, continuous errors and difficulty of use. All of this makes it impossible to carry out the electronic procedures set out in the legislation, resulting in legal uncertainty and failure to meet the objectives of this legislation. The concern of waste producers andmanagers about the current situation is such that we feel that the implementation of eSIRmay lead to the paralysis of waste collection, a very serious issue that would have health, environmental and employment consequences. The letter to the Secretary of State for the Environment also calls for the establishment of an alternative procedure that provides legal certainty when electronic procedures are not possible for reasons beyond the control of users. The aim of these electronic procedure is to make it possible to trace waste from the point of generation to the point of treatment in order to ensure the most appropriate treatment in accordance with waste type. This is something that the organisations concerned have been supporting and promoting for years, because the digitisation of this process is the cornerstone for achieving a more circular economy. However, the fact is that it is currently not possible to carry out these procedures electronically. Firstly, because the times needed to complete procedures are excessive. Despite estimates made when this new systemwas announced that it would take less than five minutes for each document to be processed, it can currently take up to an hour per document. These times are totally unfeasible if we bear in mind that some companies have to process a thousand documents per day. Currently, well under 10% of the required documents are being processed.
