A nivel legislativo, el Senado ha aprobado que se continúe la tramitación de una modificación del Código de Aguas, que introduce medidas como trasladar al sistema jurídico chileno la prioridad del abastecimiento y saneamiento respecto a otros usos, o la limitación de los años de duración de las concesiones privadas de aguas, que pasan a un periodo de 30 años. Con respecto a la Constitución, su papel en materia hídrica es más bien simbólico, ya que la capacidad de modificar la regulación del agua viene por reformas legales concretas como la del Código de Aguas, que son las que de verdad pueden hacer por cambiar la situación de una manera efectiva y real. En ese sentido, el peor favor que se le puede hacer al efectivo cumplimiento del derecho humano al agua es la ideologización del debate. to the top of the country’s political and social agenda and has become part of the constitutional debate.
